A National Call for Papers
Nirmal Jyotsna Educational Society, in association with Legalosphere, invites law students, research scholars, academicians and emerging legal researchers from across India to participate in a national research paper conference on:
“Judicial Perspective on Mediation & the Justice System”

The conference seeks to create a meaningful academic platform where legal research, judicial insight and professional experience come together to examine the growing importance of mediation in India’s justice delivery system.
With mediation increasingly recognised as an important avenue for resolving disputes in a timely, accessible and amicable manner, the conference invites original research that critically examines the evolving relationship between mediation, courts, Alternative Dispute Resolution (ADR) and access to justice.
A total of 60 selected papers will be presented before a distinguished panel of Hon’ble Judges of the High Court of Judicature at Allahabad and eminent legal luminaries.
About the Conference
India’s justice delivery system is undergoing significant change, with Alternative Dispute Resolution mechanisms receiving increasing attention. Mediation offers a path to dispute resolution that can operate alongside conventional litigation while placing emphasis on dialogue, participation and mutually acceptable outcomes.
The conference provides an opportunity for young scholars and researchers to explore this changing landscape through rigorous legal research.
The central objective is to encourage thoughtful examination of mediation from multiple perspectives—including its relationship with the judiciary, access to justice, institutional practice, technology, ethics, confidentiality and the reduction of case pendency.

Why Mediation Matters
Mediation has assumed an important place in discussions surrounding the future of justice delivery in India.
It represents an approach to dispute resolution that can provide an alternative to prolonged adversarial proceedings and can facilitate dialogue between disputing parties. The conference therefore seeks to examine mediation not only as a dispute-resolution mechanism but also as part of a broader conversation about accessibility, efficiency, institutional justice and the human dimensions of dispute resolution.

Examine the role of mediation in improving access to justice and consider how mediation may contribute to more accessible and participatory dispute resolution.
2. Judicial Approach to ADR under the Mediation Act, 2023
Explore the evolving judicial approach towards Alternative Dispute Resolution, particularly in the context of the Mediation Act, 2023.
3. Role of Courts in Institutionalising Mediation
Analyse the role of courts and judicial institutions in promoting, facilitating and institutionalising mediation within the justice delivery system.
4. Mediation in Commercial and Family Disputes
Study the application of mediation in different categories of disputes, including commercial and family matters, and examine the particular considerations that arise in each setting.
5. Cross-Border and International Commercial Mediation
Explore mediation in international and cross-border commercial disputes, including the legal and institutional issues associated with resolving disputes across jurisdictions.
6. Mediation vis-à-vis Arbitration and Conciliation
Compare mediation with other Alternative Dispute Resolution processes, particularly arbitration and conciliation, while examining their respective roles within the broader dispute-resolution framework.
7. Online and Virtual Mediation
Examine the emergence of technology-enabled dispute resolution and the opportunities and challenges presented by online and virtual mediation.
8. Mediation and Reduction of Case Pendency
Explore whether and how mediation can contribute to addressing the problem of case pendency and support more timely dispute resolution.
9. Constitutional Vision of Justice and ADR
Examine mediation and Alternative Dispute Resolution through the broader constitutional vision of justice.
10. Ethics, Neutrality and Confidentiality in Mediation
Analyse the ethical foundations of mediation, including the importance of neutrality, confidentiality, trust and professional responsibility.

Submissions are to be individually authored.

Participants are required to submit a concise research abstract based on one of the conference themes.

Selection and Presentation
A total of 60 papers will be selected from the abstracts received.
Selected researchers will present their papers in a conference-style academic setting before a distinguished panel comprising Hon’ble Judges of the High Court of Judicature at Allahabad and eminent legal luminaries.

Publication Opportunity
The conference provides an opportunity for selected research to progress beyond presentation.
Selected and best-rated papers will be considered for publication in an edited conference volume carrying an ISBN.
